By accessing or using https://dallastx.roofexpertusa.com/ (the "Website"), you agree to be bound by these Terms & Disclosures. If you do not agree with these terms, you should discontinue use of the Website immediately.
2. Independent Contractor Relationship Disclosure
ROOF EXPERT USA IS AN INDEPENDENT REFERRAL AND DISPATCH SERVICE. WE DO NOT DIRECTLY EMPLOY ROOFING TECHNICIANS, OWN REPAIR VEHICLES, OR PERFORM PHYSICAL ROOFING LABOR.
All roofing contractors participating in our referral network are independent business entities. They are not employees, agents, or joint venturers of Roof Expert USA. Roof Expert USA does not direct, supervise, or control the physical work, safety practices, tools, scheduling, or pricing of any independent provider.
3. Customer Due Diligence & Verification
While Roof Expert USA connects consumers with responsive local contractors, property owners bear the ultimate responsibility to verify the credentials of any independent provider prior to executing contracts or making payments. This includes:
- Requesting current proof of Commercial General Liability and Workers' Compensation insurance.
- Confirming local municipal business registration or trade certifications where applicable.
- Reviewing written scope of work, warranty coverage, and payment terms.
- Ensuring strict compliance with Texas House Bill 2102 regarding mandatory deductible payment.
4. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, ROOF EXPERT USA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES RESULTING FROM:
- THE PHYSICAL WORK, DELAYS, PROPERTY DAMAGE, BODILY INJURY, OR NEGLIGENCE OF ANY INDEPENDENT CONTRACTOR REFERRED THROUGH THIS SERVICE.
- DISPUTES OVER PRICING, CONTRACT SCOPE, OR WARRANTY CLAIMS BETWEEN THE PROPERTY OWNER AND THE CONTRACTOR.
- INSURANCE CLAIM DENIALS, DEDUCTIBLE DISPUTES, OR ADJUSTER DETERMINATIONS.
- TECHNICAL DISPATCH FAILURES OR COMMUNICATIONS DELAYS.
5. Texas Deductible Law Notice (HB 2102)
Under Texas Insurance Code Section 707.002 (HB 2102), a person insured under a property insurance policy must pay any deductible applicable to a claim. It is a violation of Texas law for a contractor or referral service to pay, waive, absorb, rebate, or credit all or part of an insurance deductible. Roof Expert USA complies strictly with Texas law and will not participate in or refer any entity engaging in unlawful deductible rebate schemes.
6. Dispatch Hotline & Emergency Disclaimer
Calls to (888) 208-4155 are routed directly to participating independent contractors or dispatch routing hubs. Roof Expert USA does not guarantee that a contractor will be available in every weather event or that physical repairs can be initiated during active severe storm conditions.
